What is the Performance Marketing Fairness Fund?

Administered by the Performance Marketing Association (“PMA”), the Performance Marketing Fairness Fund helps fund the legal defense against legislation that unfairly targets and threatens the livings of thousands of performance marketers, support salaries for the paid PMA Team, and supports the public relations and media efforts on important topics that affect our industry. Defending our industry in the courts is costly but crucial to protecting the livelihoods of all performance marketers.

What is the relationship between the PMA and the Performance Marketing Fairness Fund?

The Performance Marketing Association is a 501(c) 6 non-profit corporation. This trade association was founded in 2008 by the leaders of the performance marketing industry with a goal to connect, inform and advocate on behalf of this rapidly growing field. The Performance Marketing Fairness Fund is managed by the PMA and its funds will contribute to costs associated with litigation to reverse unfair legislation that has, to date, devastated the income of 76,000 small performance marketing businesses.

Supporters can choose to (1) become members of the PMA, (2) contribute to the Performance Marketing Fairness Fund, (3) become members of the PMA and contribute to the Performance Marketing Fairness Fund.

Our work to provide leadership and guidance; protect against unconstitutional laws that threaten our industry, unite local coalitions for national change and foster the growth of the Performance Marketing industry can only be made possible through funds generated through PMA memberships and contributions.

Are gifts and membership dues tax-deductible?

Contributions, gifts of income and membership dues paid to 501 (c) 6 trade associations are not tax deductible as charitable contributions for income tax purposes. However, they may be tax deductible as ordinary business expenses, subject to restrictions imposed as a result of association lobbying activities. For the current period, 18% of your member dues is non-deductible due to lobbying. You are strongly advised to consult a tax professional.

Is a contribution to this fund the same as a PMA membership?

No. A contribution to the Performance Marketing Freedom Fund is not the same as a membership with the PMA. The PMA was founded as and continues to be a membership-based organization.

Contributing to the Performance Marketing Fairness Fund is an excellent way for performance marketers to support the industry above and beyond their membership dues. It also provides a way for nonmembers to help further the PMA’s mission to defend the Performance Marketing Industry against legislation that unfairly targets and threatens the livings of thousands of performance marketers.
