Impending Litigation Notice
One of the goals of the Performance Marketing Association is to educate and inform members about legal matters that might impact the industry. Toward that end, we have received information regarding a suit filed in The United States District Court for the Western District of Texas, Austin Division, alleging, among other things, unfair competition, injury to business reputation, and interference with contracts.
The case involves Wickfire and TriMax Media and centers around affiliate marketing and, more specifically, Search Engine Marketing (SEM) through Google AdWords. Each side has made allegations against the other.
The PMA is providing this notice as informational only and is not taking any position with respect to the facts of this action.
